Mobile End User License Agreement

This End User License Agreement ("EULA") governs your use of the CoCo Parenting AI mobile applications (the "App") distributed through the Apple App Store or Google Play. The App is licensed, not sold. This EULA is between you and 15064121 Canada Inc., a federally incorporated Canadian corporation with a registered office in Quebec, doing business as CoCo Parenting AI.

This EULA supplements our Terms of Service and Privacy Policy, which also apply.

1. License grant

Subject to your compliance with this EULA and our Terms of Service, CoCo grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on any compatible device that you own or control, solely for your personal, non-commercial household parenting use.

2. Restrictions

You will not, and will not allow any third party to:

  • Copy the App, except as permitted by this EULA;
  • Modify, reverse-engineer, decompile, disassemble, or attempt to derive the source code, except to the extent applicable law expressly permits;
  • Rent, lease, lend, sell, redistribute, or sublicense the App;
  • Use the App in any way that violates applicable law or the Terms of Service;
  • Use the App to train a competing AI model or systematically extract AI outputs to build one.

3. Updates

We may provide updates and new versions of the App. Some updates may be required for the App to function properly, for security, or for compliance. You agree to install such updates.

4. Third-party terms

Your use of the App is also subject to the Apple App Store Terms of Service or Google Play Terms of Service (whichever applies), and to any terms of your mobile carrier.

5. Apple App Store — additional terms (Schedule 1)

This Section 5 applies only if you downloaded the App from the Apple App Store. It implements the minimum terms required by Apple’s Licensed Application End User License Agreement.

  • Parties. This EULA is concluded between you and CoCo only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
  • Scope of license. The license granted to you for the App is limited to a non- transferable license to use the App on any Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  • Maintenance and support. CoCo is solely responsible for providing any maintenance and support services, as required under applicable law. Apple has no obligation to furnish any maintenance or support services in connection with the App.
  • Warranty. CoCo is solely responsible for any product warranties, whether express or implied by law, that are not effectively disclaimed. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any). To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be CoCo’s responsibility.
  • Product claims. CoCo, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your possession and use of the App, including (i) product-liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer-protection, privacy, or similar legislation, including in connection with the App’s use of the HealthKit or HomeKit frameworks (if applicable).
  • Intellectual-property claims. In the event of any third-party claim that the App or your possession and use of the App infringes that third party’s intellectual-property rights, CoCo, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
  • Legal compliance. You represent and warrant that (i) you are not located in a country that is subject to a US Government embargo, or that has been designated by the US Government as a "terrorist supporting" country; and (ii) you are not listed on any US Government list of prohibited or restricted parties.
  • Developer contact. Any questions, complaints, or claims regarding the App should be directed to support@cocoparentingai.com.
  • Third-party beneficiary. You and CoCo acknowledge and agree that Apple, and Apple’s subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary thereof.

6. Google Play — additional terms

This Section 6 applies only if you downloaded the App from Google Play.

  • Your use of the App is also subject to the Google Play Terms of Service and Developer Distribution Agreement.
  • CoCo (not Google) is solely responsible for the App and any support, maintenance, warranty, or product liability.

7. Termination

This EULA is effective until terminated by you or CoCo. Your rights under this EULA will terminate automatically without notice from CoCo if you fail to comply with any of its terms. On termination you must cease all use of the App and destroy all copies of the App.

8. U.S. Government end users

The App and related documentation are "Commercial Items," as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation." Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are licensed to U.S. Government end users only as Commercial Items and only with those rights granted to all other end users.

9. Governing law

Except as required by applicable law or by Section 5 above (which may require the application of California law for interactions with Apple), this EULA is governed by the laws of the Province of Quebec, Canada, without regard to conflict-of-laws principles. Dispute resolution is governed by Sections 18 and 19 of the Terms of Service.
